TCPA – Telephone Consumer Protection Act

The first area is TCPA (Telephone Consumer Protection Act) The primary purpose of the TCPA is to reduce the number of nuisance calls. But also, and perhaps more importantly, it works to protect the consumer’s right to privacy.

What Is TCPA?

The TCPA specifically restricts the practices of telemarketers and debt collectors and their use of automated dialing (robocalls) and pre-recorded voice messages with regard to cell phones

FCRA – Fair Credit Reporting Act

Our second main consumer litigation area is FCRA (Fair credit reporting act) The purpose of this law is to ensure a creditor can violate your rights as a consumer with regard to your credit report.

What is FCRA?

Under the Fair Credit Reporting Act (FCRA), you have a right to the fair and accurate reporting of your credit information. You are also entitled to certain privacy rights concerning your credit information and protection from the misuse of your credit information.

If someone violates your rights under the FCRA, you have some remedies available.  The type of remedy will depend on whether the violation was intentional or negligent.
