How is spousal support determined?


Alimony, or spousal support, is usually granted in a divorce where there is a big economic difference between both parties. Judges will take a number of factors into consideration, including the earning capacity of both parties, debt and property arrangements, whether one spouse sacrificed career or educational opportunities to support the other, etc. Alimony will be determined based on the length of the marriage, the earning capacity of each party, the couple’s standard of living during the marriage and if there was domestic abuse or violence present in the home.
